General terms and conditions - Feinstück Raum

§1 Validity of social entrepreneurs and definitions of terms

(1) The following general terms and conditions, which are available for all deliveries between us - Feinstück Raum (hereinafter) and a consumer in their proper adjustment to the owner.

 

(2) A consumer is any person who has accepted a legal transaction for purposes that can be attributed to their commercial or independent rights (§ 13 BGB).

 

 

§2 Conclusion of a contract, storage of the contract text

(3) The presentation of the goods in our online shop does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

 

The offer is accepted in writing or in text form or by sending the ordered goods within one week. If the deadline expires without result, the offer is deemed to have been rejected.

 

(4) When an order is received in our online shop, the following rules apply: The consumer submits a binding contract offer by successfully going through the ordering procedure provided in our online shop.

 

The order takes place in the following steps:

 

1) Selection of the desired goods

2) Confirm by clicking the "Order" button

3) Checking the information in the shopping cart

4) Click on the "Checkout" button

5) Registration in the internet shop after registration and entering the registration details (e-mail address and password).

6) Another check or correction of the respective entered data.

7) Binding dispatch of the order by clicking the button "order for a fee" or "buy"

Before the binding submission of the order, the consumer can return to the website on which the customer's information is recorded and correct or correct input errors by pressing the "Back" button in the Internet browser used by him after checking his details cancel the order process by closing the Internet browser. We immediately confirm receipt of the order by an automatically generated email (confirmation of receipt). This does not yet represent an acceptance of the offer. The offer is accepted in writing, in text form or by sending the ordered goods within one week.

 

(5) Storage of the contract text for orders via our internet shop: We save the contract text and send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time at http://www.feinstueck-raum.com. You can view your past orders in our customer area under My Account -> My Orders.

 

§3 prices, shipping costs, payment

(1) The prices indicated include the statutory sales tax and other price components. In addition, there are any shipping costs (more information on shipping costs can be found on the seller's homepage).

 

(2) It should be noted that in the case of a delivery to a delivery address outside the EU countries, import taxes and duties may apply, which are payable when the delivery reaches your delivery address. The consumer is responsible for paying these import taxes and duties. Import taxes and duties differ from country to country.

Feinstück Raum has no control over these costs.

 

(3) The consumer has the option of paying in advance, instant transfer (Klarna), credit card (Visa, Master Card).

 

(4) If the consumer has chosen to pay in advance or online transfer, he undertakes to pay the purchase price immediately after the conclusion of the contract.

 

Please make sure to include your invoice number / customer number (if available). This is the only way we can correctly assign your payment. The order will only be shipped after receipt of payment.

 

§4 delivery

(1) Unless we have clearly stated otherwise in the product description, all of the items we offer are ready for dispatch within one working day. The delivery takes place here at the latest within 5 working days. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day. In the case of payment in advance, the period begins after receipt of payment.

 

The risk of accidental loss and accidental deterioration of the item sold is only transferred to the buyer when the item is handed over to the buyer, even in the case of sale by mail.

 

(2) Vouchers are given to the consumer by email or post.

§5 retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

§6 right of withdrawal of the customer as a consumer:

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

§8 warranty

(1) If the purchased item is defective, the statutory warranty regulations apply.

 

(2) We pack all things carefully and with love. If goods are delivered with obvious transport damage, the consumer is asked to complain about these errors to the deliverer immediately and to contact the seller as soon as possible. Goods that have been damaged in transit can only be taken back if the transport damage has been reported and confirmed by the parcel service upon acceptance. Failure to file a complaint or to contact us has no consequences whatsoever for the consumer's statutory warranty rights.

 

(3) The law of the Republic of Austria applies to contracts between the seller and the consumer to the exclusion of the laws on the international purchase of movable goods. This choice of law only applies to consumers if the protection granted by the mandatory provisions of the law of the state in which the consumer is habitually resident is not withdrawn from the customer.

 

(4) The seller is liable for material defects in accordance with the applicable statutory provisions.
